1. General Terms
The following terms and conditions apply to all orders placed through the e-commerce platform www.norvilsa.com by the customer (hereinafter referred to as "You") - upon registration as a user on the website - to NORVIL, SA with VAT number A33029976 (hereinafter "NORVIL," "we," or "our"), through the NORVIL website or mobile website (hereinafter norvilsa.com or "website").
These terms do not override or replace any specific contract established within the existing commercial relationships between NORVIL and its existing customers and/or distributors, who may use the website as a client portal for order processing, maintaining their specific sales conditions, subject to authorization and activation of access by NORVIL.
By using norvilsa.com, activating a user account, and/or placing an order, the customer agrees to be bound by the terms and conditions set forth in this document (the "Terms"). Please ensure that you have read and understood the Terms before placing your order.
Orders may be placed by individuals of legal age, not under guardianship, and with legal capacity to enter into contracts, as well as by companies or entities with a postal address within the peninsular territory (including Portugal) or the Balearic Islands and who provide their tax information truthfully and accurately.
The inclusion of any product or service on norvilsa.com at any given time does not imply or guarantee that such product or service will be available perpetually. We reserve the right to discontinue a product at any time and without prior notice.
NORVIL reserves the right to modify these terms occasionally without prior notice, with the version of the Terms existing on norvilsa.com at the time of placing the order or using the website always being applicable.
In order to provide a good user experience, You understand and agree to:
- Not publish, transmit, redistribute, upload, or promote any communication or content that may harm or negatively affect our image, products, or services.
- Not to act in any way or use any device that restricts, harms, interferes with, or limits any other user in the use or enjoyment of norvilsa.com, or affects the security of the site.
- Not to use any device or employ any software, tool, agent, script, or other mechanism (including but not limited to spiders, bots, crawlers, avatars, or intelligent agents) to browse or search the website, or to copy content from it.
- Not to place any false or fraudulent orders. If an order of this nature is reasonably considered to have been made, we are authorized to cancel it and inform the relevant authorities.
- Provide your email address, postal address, and/or other contact details truthfully and accurately, including the tax information that may be required depending on your customer type. In this regard, you consent that we may use such information to contact you if necessary (see our Privacy Policy).
We reserve the right to immediately access the site and may close the account of any user who violates these clauses or any other provision of these terms and conditions, without prejudice to any legal actions that may be taken.
The information or personal data you provide to us about yourself will be processed in accordance with the Privacy and Cookies Policy. By using this website, you consent to the processing of such information and data and declare that all information or data you provide to us is accurate and corresponds to reality.
2. Prices, Taxes, and Delivery Charges
The prices shown on norvilsa.com include value-added tax where applicable, as well as the corresponding breakdown of both. Delivery charges are not included and will be shown before the payment process based on the order amount and destination of the goods.
All our shipments are handled by designated transport company according to the following shipping policy:
1. Spain:
a. Península: Free shipping for orders over 100€ + ESVAT. Orders under 100€ have a cost of 5€ + VAT.
b. Balearic Islands: Free shipping for orders over 100€ + ESVAT. Orders under 100€ have a cost of 9€ + ESVAT.
c. Canary Islands: No deliveries are made to this area.
2. Portugal
a. Península: Free shipping for orders over 100€ + ESVAT. Orders under 100€ have a cost of 5€ + ESVAT.
b. Azores and Madeira: No deliveries are made to this area.
Delivery Time: 24-72 hours
The applicable prices are those indicated on the website at the time of the order. NORVIL reserves the right to modify the prices published on norvilsa.com without prior notice or notification. These possible modifications will not apply to already confirmed orders.
In accordance with Article 68 of Law 37/1992, of December 28, on Value Added Tax, the delivery of items shall be deemed to be located in the territory of application of Spanish VAT if the delivery address is in Spanish territory except for the Canary Islands, Ceuta, and Melilla. The applicable VAT rate shall be the legally prevailing rate at any given time depending on the specific article concerned. You expressly authorize us to issue the invoice in electronic format, although you may indicate at any time your willingness to receive a paper invoice, in which case we will issue and send the invoice in that format.
3. Order Processing and Shipment Tracking
To place an order, you must follow the online purchase procedure and authorize payment by clicking "Pay." After successfully completing the payment process through our payment gateway, you will receive an email confirmation of the order.
Once your order has been processed and our warehouse has prepared the shipment, you will be notified by email of the status of your shipment, with the necessary tracking details for tracking. If for any reason we are unable to complete your order, we will inform you as soon as possible.
NORVIL strives to ship orders as promptly as possible and, in the order, they are placed. Our goal is to deliver within 2-4 business days depending on the destination, once an order is confirmed. Although we endeavour to deliver orders within the communicated timeframe, delivery may be delayed due to unexpected and uncontrollable situations. In the unlikely event that the delivery time exceeds 30 days, you will have the right to cancel your order without any further justification.
All orders are subject to product availability. If exceptional circumstances arise regarding the supply of products or if items are out of stock at the time of order preparation, we will refund any amounts you may have paid, and if payment has been processed, we will refund the relevant amount by the same payment method used.
4. Order Cancellation
You have the right to cancel your order in writing from the time of purchase until 14 natural days after receipt, except for items with any kind of customization (embroidery, screen printing, patterns specially designed for the customer, or specific modifications to catalogue items at the customer's request). If the order has already been shipped at the time of cancellation, the return shipping costs will be borne by the customer.
Under no circumstances will returns be accepted for items that have been used, have stains, breakages, or any other evidence of being handled, or for those not returned with their original packaging (including but not limited to: bags, tags, hangers...) in perfect condition. In these cases, NORVIL reserves the right to apply a handling fee of 3€ per garment and will inform the customer of the items whose return has been rejected. The customer must confirm in writing whether they wish to have the rejected returned items resent. NORVIL will resend the items upon payment of the shipping costs and handling fees incurred.
The refund will be made once it has been verified that the merchandise is in perfect condition as stated above. The corresponding amount will be refunded within a maximum period of 14 natural days from the date of receipt of the return. The refund will always be made through the same payment method you used to make the purchase.
In the case of a defective product, NORVIL will proceed with its replacement or resolution of the contract at no cost to the customer.
5. Returns
NORVIL guarantees a full refund of the purchase, in accordance with the "Order Cancellation" section, provided that all items are returned in the same conditions as they were at the time of receipt. This implies that the items will not show damage or dirt, will not have been washed, altered, or worn, and that all labels, bags, hangers, or any other packaging will be intact. You will be responsible for any decrease in the value of the items resulting from handling other than that necessary to establish or verify their nature, characteristics, or operation.
All our packages contain a pre-printed return form for you to use if you decide to return any items. You must send the items you wish to return properly packaged, along with this form, to NORVIL, SA Pol.Ind. Mora Garay, C/Marie Curie 6-8, 33211 Gijón (Asturias - Spain).
Once we have received your return and checked the condition of the items, the refund will be made using the same payment method used for the purchase, in accordance with the "Payment Methods" section and within a maximum period of 14 natural days.
6. Payment Methods
You can pay for your items by credit or debit card through our payment gateway. NORVIL reserves the right to verify the validity of your credit or debit card, your credit situation in relation to the order value, and whether the buyer's address details are correct, which could result, in certain cases, in the rejection of the order.
7. Responsibilities
NORVIL accepts no liability for any indirect damages that may arise from the non-delivery of goods or from our failure to fulfill any of our obligations under these Terms, provided that such non-compliance is due to a situation beyond our reasonable control, which includes, but is not limited to, fires, floods, storms, vandalism, strikes, social unrest, wars, nuclear accidents, or terrorist activities.
The maximum liability we assume towards you for any loss or damage in connection with your order on norvilsa.com shall be limited to the total price of the order.
You will assume all responsibility for the products purchased from the moment of delivery at the agreed location. You will acquire ownership of the products when we receive full payment of all amounts due in relation to them.
8. Colors and Measurements
We make every reasonable effort to show the characteristics of our products, including their composition and colors, with maximum accuracy. The color you see will depend on your computer, and we cannot guarantee in any case that the colors of the purchased garment will be identical to those shown on the screen.
The measurements of an item provided on norvilsa.com are merely indicative and are intended to give you an idea of the model or fit of said item; they should not be understood as a definitive guarantee of the actual measurements of the item you will receive, as the final measurements of an item may vary depending on the materials used in its manufacture.
9. Warranty
In case of defects in the goods you have purchased, NORVIL complies with all mandatory regulations regarding warranty. If at the time of delivery, you notice anomalies in the package (breaks, obvious damage, or any other defect that may have altered the conditions of the contents), please notify the transport agency before collecting the package and let us know immediately.
Likewise, if upon receipt of the merchandise you notice any deficiency in the materials, manufacturing, or appearance thereof or detect any other defect in it, please notify us in writing within two days following its delivery. After this time without notification from You, NORVIL will assume that the merchandise has been delivered in perfect condition, and the conditions described in the "Returns" section of these Terms shall apply if applicable.
10. Assignment and Segregation
NORVIL reserves the right to assign payments to be made arising in connection with the delivery of goods, including any expenses due to third parties.
If a court or regulatory body disapproves or finds that any part of these Terms is not effective, the remaining Terms shall remain in force.
11. Modification of General Conditions
Norvil reserves the right to modify these General Purchase Conditions at any time. No modification will affect orders that are already in progress.
12. Applicable Law and Jurisdiction
These General Purchase Conditions are subject to Spanish law. Without prejudice to the foregoing, the consumer not residing in Spain also enjoys the protection guaranteed by the mandatory provisions of the law of the country where they have their habitual residence. The parties submit to the courts and tribunals of Gijón.
13. Ownership of Rights
All intellectual property rights, such as trademarks or copyrights existing on norvilsa.com, belong to NORVIL. Any use of norvilsa.com, its images, and/or its content, including copying or storing such content in whole or in part, for purposes other than personal and non-commercial use, is prohibited without NORVIL's express written permission.
The total or partial reproduction of any content included on the norvilsa.com site by any means, medium, or support is expressly prohibited without our express written consent.
